Scope and Contents

This collection includes most civil court cases heard by A.B.C. (Adolphus Bradshaw Clarence) DePriest in Cleveland County, North Carolina dating 1944-1956. They are arranged by case number as recorded in his court case books. The original and copied documents had been inserted in the pages of the eight record books, along with receipts and other papers pertaining to the cases. These were numbered accordingly, unfolded, and filed in oversize folders in order as removed from the books.

Biographical/Historical Note

Cleveland County, North Carolina was formed in 1841 from parts of Lincoln County and Rutherford County. It was named for Benjamin Cleveland, a colonel in the American Revolutionary War, who took part in the Battle of King's Mountain. From 1841 to 1887 "Cleaveland" was the spelling used; the present spelling was adopted in 1887.

The county is divided into eleven townships, which are both numbered and named: 1 (River), 2 (Boiling Springs), 3 (Rippy), 4 (Kings Mountain), 5 (Warlick), 6 (Shelby), 7 (Sandy Run), 8 (Polkville), 9 (Double Shoals), 10 (Knob Creek), and 11 (Casar).

It is believe that this Justice of the Peace, A.B.C. DePriest is Adolphus Bradshaw Clarence DePriest (1881-1965) who lived in Shelby, North Carolina. DePriest served Cleveland County, Township Number 6, according to his case papers.

Abstract

This collection houses legal documents issued and ruled by Justice of the Peace A.B.C. DePriest of Cleveland County, North Carolina between 1944 and 1956. Records remain in the order as was filed in the case books.

Arrangement

Within the original case books were folded original and copied summons, affidavits, ejection proceedings, receipts, and other papers relating to many legal cases in Cleveland County, North Carolina between 1944 and 1956. The folded papers were removed and flattened, numbered per case number in book, removed staples, and kept in the original order.

In two of the books, DePriest had misnumbered and/or reused case numbers, which is noted on the folders and in the inventory. There were sometimes case papers that had no corresponding case number or page in the books, and those are filed at the end of the folder of the book from which they were removed.

Processed by Anita Elliott, August 2013. This collection was processed as part of a grant from the National Historical Publications and Records Commission. The grant funded extensive processing of the backlog within the W. L. Eury Appalachian Collection between 2012 and 2014.
